Before downloading any documentation, carefully read the DIGITAL DOCUMENTATION LICENSE AGREEMENT set forth below. If you do not agree to its terms, do not download or use in any manner any of the DIGITAL DOCUMENTATION.
DIGITAL DOCUMENTATION shall mean DIGITAL'S documents identified in Appendix A or any part of such documents.
Subject to the restrictions set forth in Article 4, DIGITAL grants you a non-exclusive, royalty-free license under DIGITAL's intellectual property rights to use the DIGITAL DOCUMENTATION only for non-commercial purposes, including research and teaching.
The DIGITAL DOCUMENTATION is owned by DIGITAL and its suppliers and is protected by copyright laws and international treaties. Your use of the DIGITAL DOCUMENTATION is subject to the applicable copyright laws and the express rights and restrictions of this License Agreement.
You may not copy or modify the DIGITAL DOCUMENTATION after downloading it.
You may not transfer your rights to use the DIGITAL DOCUMENTATION, or the DIGITAL DOCUMENTATION itself, without DIGITAL'S written authorization.
You may not rent or lease the DIGITAL DOCUMENTATION except as expressly authorized in this License Agreement. You may not remove any copyright, trademark or other proprietary notices from the DIGITAL DOCUMENTATION or the media.
DIGITAL is under no obligation to supply error corrections, updates, training, support or consulting to you for, or in relation to the DIGITAL DOCUMENTATION.
THE DIGITAL DOCUMENTATION UNDER THIS AGREEMENT IS PROVIDED "AS IS". DIGITAL DISCLAIMS ALL WARRANTIES WITH REGARD TO THE DIGITAL DOCUMENTATION, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE. DIGITAL DOES NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING THE USE OF, OR THE RESULTS OF THE USE OF, THE DIGITAL DOCUMENTATION, OR WITH RESPECT TO ITS CORRECTNESS OR ACCURACY OR THAT THE DIGITAL DOCUMENTATION WILL BE ERROR FREE. IT IS EXPRESSLY UNDERSTOOD AND AGREED THAT DIGITAL MAKES NO REPRESENTATIONS OR WARRANTIES THAT DIGITAL DOCUMENTATION IS FREE FROM INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHT OWNED BY A THIRD PARTY.
DIGITAL AND ITS SUPPLIERS ASSUME NO RESPONSIBILITY OR LIABILITY TO YOU FOR LOSS OR DAMAGES, WHETHER DIRECT OR INDIRECT, CONSEQUENTIAL OR INCIDENTAL, WHICH MIGHT ARISE OUT OF YOUR USE OF THE DIGITAL DOCUMENTATION. THIS LIMITATION WILL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT OR TORT INCLUDING, WITHOUT LIMITATION, NEGLIGENCE. THE FOREGOING LIMITATION DOES NOT APPLY TO DAMAGES RESULTING FROM PERSONAL INJURY CAUSED BY DIGITAL'S NEGLIGENCE.
IN NO EVENT WILL DIGITAL OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES RESULTING FROM LOSS OF DATA OR USE OR LOST PROFITS.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. Therefore, the above limitation or exclusion may not apply to you.
After written notice of a breach, and thirty (30) days to cure, DIGITAL may terminate the license granted hereunder for any material breach by you. In the event of any termination of this License Agreement, you shall cease to use the DIGITAL DOCUMENTATION immediately upon date of termination and shall destroy/delete your copy of the DIGITAL DOCUMENTATION.
Commercial computer software, computer software documentation and technical data for commercial items are limited to the U.S. Government under Digital's standard commercial license and, where applicable, the rights in DFARS 252.227-7015, "Technical Data - Commercial Items."
You are responsible for compliance with all applicable export or re-export control laws and regulations if you export the DIGITAL DOCUMENTATION. This Agreement is governed by, and is to be construed under, the laws of the Commonwealth of Massachusetts.
